GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions govern the purchase of products sold through the website www.jalyd.com.
2. Scope of Application
These General Terms and Conditions of Sale apply to all purchases made through the website by consumers and professional customers.
Submitting an order implies full acceptance of these Terms and Conditions.
The Seller reserves the right to amend these Terms and Conditions at any time. Any amendments shall take effect from the date on which they are published on the website.
3. Products and Availability
Information and product specifications are provided on the relevant product description pages.
Product images are for illustrative purposes only and may not perfectly represent the actual characteristics of the products.
The availability of products shown on the website is indicative only. In the event of total or partial unavailability after an order has been placed, the Customer shall be promptly informed and may choose between a refund, a replacement product or waiting for the product to be restocked.
4. Conclusion of the Contract
The order submitted by the Customer constitutes a contractual offer.
The contract shall be deemed concluded when the Seller sends the order confirmation to the email address provided by the Customer.
The Seller reserves the right to refuse or cancel orders for justified reasons, including pricing errors, product unavailability, incomplete information or suspected fraudulent activity.
5. Prices
All prices published on the website are expressed in euros.
Prices include VAT where applicable and do not include any shipping costs, which shall be shown separately before the order is completed.
The Seller reserves the right to change prices at any time. Any changes shall not apply to orders that have already been confirmed.
Where a clearly incorrect price is published as a result of a material or technical error, the Seller reserves the right to cancel the order and refund any amounts already paid.
6. Payment Methods
The following payment methods are accepted:
  • PayPal;
  • credit and debit cards through XPay;
  • advance bank transfer;
  • cash on delivery, only within Italy and where available.
All payments are processed by certified third-party service providers.
The Seller does not directly store or process payment card details.
7. Shipping and Delivery
Products are shipped through express couriers selected by the Seller.
The delivery times indicated on the website are estimates only and do not constitute an essential term of the contract.
Upon delivery, the Customer must verify:
  • the integrity of the packaging;
  • that the number of packages corresponds to the number indicated;
  • the absence of any visible damage.
Any irregularities must be immediately reported to the courier by adding a specific written reservation to the delivery document.
7-bis. Transfer of Risk
For consumer Customers, the risk of loss of or damage to the products shall pass when the Customer, or a third party appointed by the Customer other than the carrier, physically takes possession of the goods.
For professional Customers, the risk shall pass when the products are delivered to the carrier responsible for transportation, unless otherwise provided by mandatory law.
8. Right of Withdrawal
Pursuant to Articles 52 et seq. of Italian Legislative Decree No. 206/2005, the Consumer Code, consumer Customers have the right to withdraw from the purchase within 14 (fourteen) calendar days from the date on which the products are delivered.
To exercise the right of withdrawal, the Customer must send a written notice to customercare@jalyd.com, specifying:
  • the order number;
  • the purchaser’s name;
  • the products covered by the withdrawal request.
8-bis. Proper Use of Products
The Customer undertakes to use the purchased products exclusively for their intended purpose and in accordance with the instructions provided on the packaging, labels, technical data sheets and any other instructions supplied by the Seller or manufacturer.
The Seller shall not be held liable for damage, adverse effects, alterations, product ineffectiveness or any other consequences resulting from improper or negligent use, use that does not comply with the instructions or use for purposes other than those intended.
The cosmetic and haircare products sold by HAIR BIOLOGIC SYSTEM SRL are intended for external, professional or domestic use, as specified on the relevant product pages.
9. Return Conditions
The products must be returned within 14 days from the date on which the withdrawal notice is sent.
For a return to be accepted, the product must be:
  • intact;
  • unused;
  • unopened, where sealed;
  • free from alterations or tampering;
  • complete with any accessories and documentation;
  • returned in its intact original packaging.
The Customer shall be responsible for any reduction in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics and functioning.
The direct cost of returning the products shall be borne by the Customer.
10. Exclusions from the Right of Withdrawal
Pursuant to Article 59 of the Italian Consumer Code, the right of withdrawal is excluded for:
  • products which, for hygiene or health protection reasons, cannot be returned once opened;
  • cosmetic, haircare, personal care or professional-use products that have been opened, used, deprived of their original seal or are otherwise no longer suitable for resale for hygiene and safety reasons.
11. Refunds
The Seller shall issue the refund within 14 days from receipt of the withdrawal notice.
The refund may be withheld until the returned products have been received or until the Customer provides evidence that the products have been shipped, whichever occurs first.
The refund shall be made using the same payment method used for the original purchase, unless otherwise agreed between the parties.
12. Legal Guarantee of Conformity for Consumers
Consumer purchases are covered by the legal guarantee of conformity provided for by Articles 128 et seq. of Italian Legislative Decree No. 206/2005, the Consumer Code.
The guarantee lasts for 24 months from delivery of the goods and covers defects of conformity existing at the time of delivery.
In the event of a lack of conformity, the consumer shall be entitled to the remedies provided by the applicable legislation, within the limits and subject to the conditions established by law.
13. Guarantee for Professional Customers
For purchases made by persons acting in the course of their business, commercial, craft or professional activities, the legal guarantee of conformity provided by the Consumer Code shall not apply.
The warranties provided for by Articles 1490 et seq. of the Italian Civil Code shall remain applicable.
Any defects or non-conformities must be reported by the professional Customer within the time limits established by the applicable legislation.
In any event, the Seller shall not be liable for defects resulting from improper storage, incorrect use, use that does not comply with the instructions or alterations made to the products after delivery.
14. Invoicing
The relevant tax document shall be issued for each order in accordance with the applicable legislation.
Professional Customers are responsible for ensuring that the tax information provided during the purchase process is accurate and complete, including the VAT number, tax code, SDI recipient code and any certified email address.
Requests to amend tax information after the relevant tax document has been issued may only be accepted where permitted by the applicable legislation.
15. Limitation of Liability
The Seller shall not be liable for delays or failure to perform resulting from force majeure events, adverse weather conditions, strikes, logistical issues, measures adopted by public authorities or other events that are not reasonably within the Seller’s control.
The Seller’s liability shall remain unaffected in all cases where liability cannot be excluded under the applicable legislation.
16. Privacy
Personal data are processed in accordance with Regulation (EU) 2016/679 and the applicable Italian data protection legislation.

17. Complaints and Customer Support
Any complaints, support requests, disputes or reports relating to orders must be sent to customercare@jalyd.com, specifying:
  • the order number;
  • the purchaser’s details;
  • a detailed description of the issue;
  • any photographic documentation, where necessary.
HAIR BIOLOGIC SYSTEM SRL undertakes to respond as soon as reasonably possible.
18. Alternative Dispute Resolution (ADR)
Consumers may use any alternative dispute resolution procedures available under the applicable legislation.
In all cases, the consumer’s right to bring proceedings before the competent judicial authority in accordance with the law shall remain unaffected.
19. Applicable Law and Jurisdiction
These General Terms and Conditions shall be governed by Italian law.
For any dispute brought by a consumer, jurisdiction shall lie with the court of the consumer’s place of residence or domicile, provided that it is located within the territory of the Italian Republic.
For all disputes relating to contractual relationships with professional Customers, the Court of Rome shall have exclusive jurisdiction.
